The following terms of Use And Warranty Policy govern how Customers may use MKT Software, an online business and marketing support tool. Customers are required to read and understand these terms when using the software. MKT Software publicly provides these terms to ensure that the software is used for its intended purposes, in compliance with Vietnamese law, and to protect the legitimate rights and interests of Customers.
1. Terms of Use
MKT Software is an online business and marketing support tool designed to help Customers manage customer relationships, optimize costs, and improve operational efficiency. We aim to create value for the community and contribute to the country’s digital transformation. The software is developed in compliance with Vietnamese law, including:
- The 2018 Law on Cybersecurity No. 24/2018/QH14, effective from January 1, 2019.
- The 2005 Civil Code No. 33/2005/QH11, effective from January 1, 2006.
- Decree No. 72/2013/ND-CP on the management, provision, and use of Internet services, effective from September 1, 2013.
- Decree No. 13/2023/ND-CP on Personal Data Protection, effective from July 1, 2023.
- The 2023 Law on Protection of Consumer Rights No. 19/2023/QH15, effective from July 1, 2024.
Customers are permitted to:
- Use MKT Software for lawful business purposes, such as identifying potential customers, running advertising campaigns, providing customer care, or conducting customer marketing activities to optimize costs and improve business performance.
- Receive technical support from the MKT Software support team when the software is used for its intended and lawful purposes.
Customers are STRICTLY PROHIBITED from using MKT Software to:
- Conduct activities against the Socialist Republic of Vietnam, threaten national security, or disrupt public order.
- Disseminate war propaganda, terrorism-related content, incitement to violence, obscene content, superstitious content, or false information.
- Carry out cyberattacks, infringe upon privacy rights, or distribute fraudulent or falsified information.
- Defame, insult, or damage the honor, dignity, or reputation of any individual or organization.
- Advertise, purchase, or sell goods or services prohibited by law.
- Commit fraud, facilitate fraudulent activities, or engage in any activity that violates Vietnamese law.
Customers must not:
- Copy, modify, reverse engineer, or use MKT Software to develop competing products.
- Overload, disrupt, damage, or otherwise harm MKT Software’s server systems.
Customer Responsibilities
- Customers shall bear full legal responsibility for any violation of the above provisions.
- MKT Software shall not be held legally liable where a Customer uses the software for improper purposes or in violation of the law.
2. Information Security and Privacy
We collect Customers’ personal information, including full name, email address, telephone number, and organizational information, for the following purposes:
- Managing accounts and granting access rights to MKT Software.
- Supporting Customers and sending notifications regarding software updates, service renewals, or promotional programs.
- Resolving disputes or complaints related to the use of the software.
Privacy and Security Commitments
- Customer information shall be securely stored throughout the operation of MKT Software in compliance with Decree No. 13/2023/ND-CP on Personal Data Protection.
- Customers’ personal data shall be retained for a maximum period of five years from the date they stop using the software, unless otherwise required by law. After this period, the data shall be permanently deleted or anonymized.
- We apply appropriate and effective security measures to protect Customer data against theft, unauthorized access, accidental disclosure, or unintended loss.
- We do not share, sell, or lease Customers’ personal information to third parties, except where:
- The Customer has provided explicit consent in writing or through a specific affirmative action, such as authorization.
- A competent state authority requires disclosure in accordance with applicable law.
- Disclosure is necessary to protect the rights, property, or safety of MKT Software or other persons.
- Customers have the right to request access to, correction of, or deletion of their personal information in accordance with applicable law.
Customer Responsibilities
- Customers must keep their account information, including usernames and passwords, secure and must notify us immediately upon discovering any unauthorized access.
3. Third-Party Resources
MKT Software does not provide, exchange, sell, or distribute any third-party resources, including social media accounts such as Facebook or Zalo accounts, advertising services, or any external tools, through either official or unofficial channels.
Customers are solely responsible for obtaining, managing, and ensuring the legality of any third-party resources used in connection with MKT Software.
MKT Software shall not be liable for any issue relating to third-party resources, including:
- Account suspension or termination, data loss, or violations of third-party platform policies.
- Issues arising from the use, exchange, purchase, or sale of third-party resources.
We provide and assume responsibility solely for MKT Software and shall not be responsible for any issue relating to third-party resources.
4. Software Ownership
MKT Software, including its source code, design, content, and all related components, is the property of MKT Software and is protected under the 2006 Law on Information Technology and applicable international intellectual property regulations.
Customers are permitted to use MKT Software for internal business purposes. This right is granted solely to the Customer and may not be transferred, sold, assigned, or shared with any other person or organization.
Customers must not copy, modify, reverse engineer, or use MKT Software beyond the permitted scope.
Customers confirm that they are at least 18 years old or have obtained the consent of a lawful guardian to use MKT Software.
5. Performance and Limitation of Liability
MKT Software is provided on an “as is” basis and is regularly updated. The software may not be error-free, may not operate continuously, and may not be compatible with every device, operating system, or hardware configuration.
The software may be temporarily suspended for maintenance, updates, or unexpected technical issues.
Errors or disruptions caused by third-party platforms, such as social media platforms, advertising services, or external APIs, are beyond the control of MKT Software. Resolving such issues may take time because it depends on the relevant platform provider. We do not accept responsibility for the time required or the outcome of any corrective action.
Disclaimer of Liability
MKT Software shall not be liable for any loss or damage, including loss of data, profits, or business opportunities, arising from the use of or inability to use the Software, except where otherwise required by law.
To the fullest extent permitted by law, MKT Software’s total liability shall be limited to the amount paid by the Customer for use of the Software during the 12 months preceding the occurrence of the relevant issue.
In accordance with the 2023 Law on Protection of Consumer Rights No. 19/2023/QH15, we are committed to providing accurate information and promptly handling Customer complaints. However, we shall not be liable for any damage caused by the Customer or a third party.
6. Warranty and Support
MKT Software is an online software product that does not require manual warranty servicing or maintenance. The system automatically updates features, releases new versions, and implements new policies without disrupting the Customer’s work.
Seven-Day Warranty Policy
Within seven days from the date of purchase or activation of MKT Software, if the software does not operate as described in the user documentation,The software does not function as described, demonstrated, or advertised by the seller prior to purchase.and we do not guarantee that a solution or software update will always be available. the Customer may request a refund, or we will provide support to resolve the issue.
Eligibility Conditions
- The software must be used in accordance with the instructions provided in the “User Guide” section of the website: https://mktsoftware.vn/.
- The Customer must provide a description of the issue and supporting evidence, where available.
- This policy does not apply where the software is damaged or fails due to the Customer’s actions, including incorrect installation, use contrary to the instructions, or interference with the source code.

We will respond within 24 hours. Where a refund is approved, it will be issued through the original payment method within five business days.
This policy complies with Article 30 of the 2023 Law on Protection of Consumer Rights by publicly specifying the warranty period, scope, and applicable conditions.

7. Termination of Use
MKT Software reserves the right to terminate or suspend a Customer’s access if:
- The Customer violates any provision of these Terms.
- We decide to discontinue MKT Software, with or without prior notice.
- The Customer causes damage or loss to MKT Software, including legal costs or losses resulting from the Customer’s unlawful or non-compliant conduct.
Where the Customer causes such damage or loss, the Customer shall be responsible for providing appropriate compensation.
8. Amendments to the Terms
MKT Software reserves the right to amend these Terms at any time in order to comply with applicable law or improve its services.
Any changes will be announced by email or published on the website at https://mktsoftwareglobal.com.. Customers should review the website regularly to remain informed of the latest updates.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of Vietnam, including the 2006 Law on Information Technology, the 2018 Law on Cybersecurity, Decree No. 13/2023/ND-CP on Personal Data Protection, and the 2023 Law on Protection of Consumer Rights.
Any dispute arising from or relating to these Terms shall be resolved by a competent court in Vietnam.
Where transactions involve international users, such users must comply with both the laws of their country of residence or operation and the laws of Vietnam.
MKT Software continually strives to ensure transparency and compliance with international standards relating to privacy, consumer protection, and cybersecurity.
Definitions
“MKT Software” means the software platform developed and owned by MKT Solutions Joint Stock Company, including tools supporting business activities, online marketing, advertising, and customer care.
“Customer” means any individual or organization that lawfully registers to use MKT Software.
“Third-Party Resources” means accounts, services, or other resources that are not under the control of MKT Software, including Facebook, Zalo, Gmail, and Google Ads accounts or services.
“Personal Data” includes identifying information, such as names, telephone numbers, email addresses, and other related information as defined under Decree No. 13/2023/ND-CP.
